Comedian Kunal Kamra Faces Legal Trouble: Three FIRs Registered in Mumbai for His Comments on Eknath Shinde

Stand-up comedian Kunal Kamra is embroiled in another scandal as fresh legal trouble began after three separate cases were filed against him at Khar police station in Mumbai. The complaint alleged his controversial comments while the recent stand-up performance was directed towards Maharashtra’s Deputy Chief Minister, Eknath Shinde. These complainants include the Mayor of Jalgaon city, a hotelier, and a businessman from Nashik. Mumbai Police has stated that investigations are still ongoing.

Kamra did not appear for an investigation after twice being called by the Khar police for questioning. In response to his non-cooperation, the police have now issued a third summons asking him to report to the Khar police station on March 31. This case was filed by Shiv Sena MLA Murji Patel, demanding utmost action against Kamra for his statements. If Kamra fails to turn up again, the escalation of legal actions will ensue.

Madras High Court Grants Kamra Interim Bail

As the legal pressures mounted, the Madras High Court intervened to relieve him for sometime. Justice Sunder Mohan gave him interim anticipatory bail to Kamra till April 7 on Friday with specific conditions to prevent immediate arrest. Citing threats received after his satirical assertions, Kamra approached the court seeking an anticipatory bail transit. The ruling has given him sufficient time to prepare for his defense without the immediate threat of detention.

Kamra’s Criticism of India’s Mainstream Media

Not really bothered by any of this, Kamra went on to ridicule the mainstream media as having become nothing but a ruling party instrument of propaganda in his post on social media. He railed against the media’s reports and what he considers slanted and wrong accounts in a strongly worded statement on X (formerly Twitter).

“To all those hounding for a quote-the mainstream media at this point is nothing but an arm of miscommunication for the ruling party. They are vultures reporting on issues that do not concern the life of this nation. If they all shut shop from tomorrow till eternity, they will do a favor to this country, its people, and their own children.” Kamra wrote.

His statement received strong reactions, with some of them supporting his statement while others criticized him with harsh comments for attacking the credibility of the media.

Political Backlash and Venue Vandalism

The whole controversy started after Kamra allegedly called Eknath Shinde a “gaddar” (traitor) in one of his performances. His joke created a huge uproar among the followers of Shinde and it was rumored that action would be sought against him. Various political leaders came out condemning him for making such statements as disrespectful and ill-mannered.

In retaliation, the Yuva Sena, which is the youth wing of Shinde’s faction of Shiv Sena, vandalized the Habitat comedy venue in Mumbai where Kamra held the show. Videos circulating in social media show shattered property and protestors shouting slogans against the comedian. This event raised the alarm on intolerance with respect to comedy and free speech in India.

Kamra’s Response: No Apology, but Will Cooperate.

Despite all the pressure, Kamra never apologizes for his comments. He stood by his right to satire and commented that such vandalism of a comedy venue would mean that the venue will have to take responsibility for the words of a comedian.

“A space for variety of shows. Habitat (or any venue) is not responsible for my comedy, nor it can have any power or control over what I say or do. Nor an political party. Attacking a venue for a comedian’s words seems as senseless as overturning a lorry which carries tomatoes because you didn’t like the butter chicken you were served,” said Kamra in a statement.

He also addressed the threats to him, for the fact that the politicians and their supporters are unable to take a joke does not affect his constitutional right of freedom of speech.

“Our right to freedom of speech and expression is not only to be used to fawn over the powerful and rich albeit today’s media would have us believe otherwise. Your inability to take a joke at the expense of a powerful public figure does not change the nature of my right. As far as I know, it is not against the law to poke fun at our leaders and the circus that is our political system,” added Kamra.

Enable Legal Precedents and Freedom of Speech Debate

The debate around freedom of speech in India has been reopened by the case of Kamra, especially in the pending issue of a comedy-satire space. Legal eagle and free speech advocates argue that, however, provocative, his words needed to be protected under Article 19(1)(a) of the Indian Constitution, providing freedom of expression.
