The Union Home Ministry (MHA) has recently released an MHA Updates List in which 67 organizations have been designated as terrorist organizations and illegal associations. These organizations have been banned under the Unlawful Activities (Prevention) Act (UAPA). This step has been taken to ensure the security of the country and to crack down on terrorism and extremism.
According to the list released by the Home Ministry, 45 organizations have been classified as terrorist organizations under Section 35 of the UAPA and have been included in the first schedule of the Act. The remaining 22 organizations have been declared illegal associations under Section 3(1) of the UAPA.
Banned terrorist organizations
These organizations include many groups that have long been involved in separatist, militant and terrorist activities in India. The major organisations included in these are:
- Khalistani terrorist organisations: Babbar Khalsa International, Khalistan Commando Force, Khalistan Zindabad Force, International Sikh Youth Federation, Khalistan Tiger Force and Khalistan Liberation Force.
- Islamic terrorist organisations: Lashkar-e-Taiba (including The Resistance Front), Jaish-e-Mohammed (including People’s Anti-Fascist-Front), Harkat-ul-Mujahideen, Hizbul Mujahideen, Al-Umar-Mujahideen, Al-Badr, Jamaat-ul-Mujahideen Bangladesh (JMB), Islamic State (ISIS) and other associated organisations.
- Militant organisations active in Northeast India: United Liberation Front of Assam (ULFA), National Democratic Front of Bodoland (NDFB), People’s Liberation Army (PLA), United National Liberation Front (UNLF), People’s Revolutionary Party of Kangleipak (PREPAK), Kangleipak Communist Party (KCP), and National Socialist Council of Nagaland (NSCN-K).
- Maoist and Naxalite organisations: Communist Party of India (Maoist) and all its affiliate organisations, Communist Party of India (Marxist-Leninist) – People’s War, Maoist Communist Centre (MCC).
- Other banned organisations: Students Islamic Movement of India (SIMI), Liberation Tigers of Tamil Eelam (LTTE), Hizb-ut-Tahrir (HUT), Jammu and Kashmir Ghaznavi Force (JKGF), and Tehreek-ul-Mujahideen (TUM).
Banned illegal associations
In addition, the government has declared 22 organisations as illegal associations, which have been found to be involved in anti-national activities. These include:
- Students Islamic Movement of India (SIMI)
- United Liberation Front of Assam (ULFA)
- All Tripura Tiger Force (ATTF)
- National Liberation Front of Tripura (NLFT)
- Hynnewtrep National Liberation Council (HNLC)
- Liberation Tigers of Tamil Eelam (LTTE)
- National Socialist Council of Nagaland (NSCN-K)
- Islamic Research Foundation (IRF)
- Jamaat-e-Islami, Jammu and Kashmir
- Jammu and Kashmir Liberation Front (Yasin Malik faction)
- Sikhs for Justice (SFJ)
- Popular Front of India (PFI) and its affiliates
- Jammu and Kashmir People’s League (Mukhta Ahmed Waza, Bashir Ahmad Tota, Ghulam Mohammad Khan Sopori and Aziz Sheikh factions)
UAPA: Tough law against terrorism
Unlawful Activities (Prevention) Act (UAPA), 1967, India’s main anti-terrorism law Which has been amended from time to time. This law was made more stringent after the 2008 Mumbai attacks.
Under this law, if an organization is declared terrorist, then:
- Its properties can be confiscated.
- Members of the organization can be arrested.
- The operation, funding and recruitment of the organization is completely banned.
